La Veeduría Ciudadana Nueva Colombia, presentó denuncia pública ante la Procuraduría y Contraloría General de la Nación por lo que consideraron graves irregularidades en el marco del proceso de contratación RTVC-IA-002-2025, cuyo objeto es “RTVC REQUIERE CONTRATAR LA PRESTACIÓN DEL SERVICIO INTEGRAL CONSISTENTE EN LA ADMINISTRACIÓN, OPERACIÓN Y MANTENIMIENTO DE LA INFRAESTRUCTURA FISICA Y TECNOLÓGICA QUE CONFORMA LA RED DE TRASMISIÓN A NIVEL NACIONAL, INCLUYENDO INFRAESTRUCTURA DE TELEVISIÓN ANALÓGICA, TELEVISIÓN DIGITAL TERRESTRE (TDT) Y ESTACIONES DE RADIO AM/FM”.
Entre las principales irregularidades en dicho proceso, la veeduría ciudadana Nueva Colombia destaca las falencias en el proceso de planeación contractual y toma de decisiones contrarias a Derecho. Según la veeduría Nueva Colombia, RTVC no solo no dio respuesta de fondo a las observaciones presentadas por parte de los interesados, sino que lo hizo por fuera del plazo de vencimiento que la misma entidad había dispuesto en el cronograma del proceso contractual que adelantaban, al extremo de cambiar aspectos de los estudios previos y modificar el cronograma violando los plazos fijados para expedir adendas.
Con este proceder por parte de RTVC, la veeduría advierte que “se estaría materializando una interpretación arbitraria y caprichosa por parte de la Entidad sobre las reglas que esta misma estableció, vulnerando así la confianza legítima de cualquier interesado en que el proceso se adelantará de conformidad bajo parámetros prestablecidos y aplicables a todas las partes por igual.”
Pese a las múltiples observaciones frente al proceso y la solicitud de la veeduría de revocar la Resolución N° 0124 de 2025 del 3 de julio de 2025 mediante la cual RTVC dio apertura del proceso de selección, este siguió adelante hasta el lunes 28 de julio a las 11:59 pm, plazo en que debía adjudicarse (Adenda N° 3).
Dado que el plazo de adjudicación se venció y no se emitió resolución de adjudicación o de declaratoria de desierto de este proceso contractual, “con la consecuencia legal prevista en la Ley de pérdida de la facultad para hacerlo”, la veeduría Nueva Colombia presentó SOLICITUD DE REVOCATORIA DIRECTA DE LA RESOLUCIÓN DE APERTURA DEL PROCESO DE CONTRATACIÓN POR ILEGALIDAD.
Durante el cuestionado proceso de contratación los medios públicos de RTVC, Señal Colombia y RTVC Noticias publicaron el 15 de julio en la red social X notas periodísticas destacando que con este RTVC avanza en el fortalecimiento del sistema de radio y televisión pública, recuperando la gobernanza tecnológica, y garantiza la continuidad del servicio de radio y televisión pública para todos los colombianos. No obstante, a la fecha de finalización del proceso de contratación RTVC-IA-002-2025, la entidad no emitió ni publicó resolución de adjudicación ni de declaratoria de desierto el proceso de contratación, el cual sólo tuvo un oferente supuestamente habilitado, cuestionado por los demás interesados, y otro cuya oferta fue entregada pero no estuvo disponible por no abrir los archivos.

Adicionalmente, VoxPública tuvo conocimiento de la preocupación del personal de vivientes u operadores ubicado en las estaciones de trasmisión, como es el caso de la Estación Cerro Kennedy, una entre cientos que hay en el país, y de los profesionales de apoyo en las diferentes zonas del país, quienes manifiestan no tener contrato ni de trabajo ni de servicios y estar actualmente en un limbo inexplicable, porque no reciben información ni instrucciones sobre lo que deben hacer y encontrarse sin pago de su trabajo.
Este cuestionado proceso de contratación se suma a las varias notas periodísticas publicadas durante el primer semestre de 2025 en medios de comunicación como EL TIEMPO, WRADIO, EL COLOMBIANO, CAMBIO e INFOBAE, poniendo de presente cuestionamientos de fondo a los procesos de contratación de RTVC durante junio de 2024 y la operación directa en marzo de 2025.
