Juzgado Tercero Administrativo de Santa Marta admite demanda interpuesta por Junta de Acción Comunal sector Bello Horizonte, Edificio Bunsichari resort, Edificio Bello Mar y conjunto residencial Sintana Resort, quienes solicitaron la protección de «los derechos colectivos a la existencia de un equilibrio ecológico, el goce del espacio público y la defensa de los bienes de público, la seguridad y salud públicas, el acceso a una infraestructura que garantice la salubridad pública, derecho a la seguridad, así como, aprobación de desastres y la realización de las construcciones, edificaciones y desarrollos urbanos respetando las disposiciones jurídicas, de manera ordenada, y dando prevalencia al beneficio de la calidad de vida de los habitantes.»
En razón de la solicitud hecha por el apoderado de la parte actora (Abg ANDRÉS ÁLVAREZ) y considerando que las Curadurías Urbanas tienen la función de estudiar, tramitar y expedir las licencias de urbanismo o construcción en la zona del municipio o distrito que le hayan asignado, el Despacho procederá a vincular al proceso a las Curadurías Urbanas número 01 y Curaduría Urbana número 02 del Distrito de Santa Marta.
Ante la solicitud de medida cautelar por parte de la parte actora, el Juzgado ordena «correr traslado para que el Distrito de Santa Marta – Secretaria de Planeación Distrital y el Concejo Distrital de Santa Marta, la Curaduría Urbana No. 01 y la Curaduría Urbana No. 02 del Distrito de Santa Marta se pronuncien sobre estas solicitudes en escrito separado dentro del término de cinco (5) días contados desde la notificación del presente auto.»
Las medidas cautelares solicitadas consisten en:
“1. Que, se ordene de manera inmediata al Distrito de Santa Marta – Secretaría de Planeación Distrital, la suspensión provisional de los efectos normativos y administrativos derivados de la clasificación urbanística del Sector Bello Horizonte como “Suelo Urbano con Tratamiento de Consolidación” dentro del Plan de Ordenamiento Territorial “POT Santa Marta 500 años”, y en consecuencia: Se excluya dicho sector de la categoría de Tratamiento de Consolidación y se le clasifique transitoriamente como Suelo Urbano
en Tratamiento de Desarrollo, hasta tanto se adopten medidas técnicas, ambientales, urbanísticas y de servicios públicos que garanticen el cumplimiento de los requisitos legales exigidos para dicha clasificación.2. Suspensión inmediata de la expedición de licencias de construcción en el Sector Bello Horizonte por cuenta de las Curaduría de la ciudad.
3. Ordenar a la Alcaldía Distrital, ESSMAR E.S.P., ejecutar en término perentorio las obras de infraestructura sanitaria en el sector de Bello Horizonte en Santa Marta.
4. Implementar monitoreo ambiental permanente de la calidad del agua marina en las playas de Bello Horizonte.
5. Disponer la realización de brigadas periódicas de salud pública en el sector Bello Horizonte.
6. Ordenar la revisión urgente del POT 500 años con participación ciudadana y actualización de la clasificación urbanística del Sector Bello Horizonte.
7. Suspensión inmediata de todas las obras civiles de construcción actualmente en ejecución en el Sector de Bello Horizonte (Santa Marta), hasta tanto la Curaduría Urbana competente, la Secretaría de
Planeación Distrital o la autoridad urbanística certifiquen la existencia de una Licencia de Urbanización previa y vigente, que justifique jurídicamente la expedición de las Licencias de Construcción otorgadas.”
