¿Sabía usted que la vulneración del derecho a la salud por parte de una EPS también se configura cuando esta niega el transporte necesario para que un paciente o su acompañante accedan a servicios de salud? Pues es así, especialmente si se trata de traslados a otras ciudades o municipios, y el paciente carece de recursos económicos para cubrir los gastos. La jurisprudencia ha establecido que las EPS deben garantizar el acceso a estos servicios, especialmente cuando se trata de personas con discapacidad, niños, niñas y adolescentes, y adultos mayores, o cuando la falta de transporte ponga en riesgo la vida o la integridad del paciente.
En Colombia, hablar de derecho a la salud ya no se limita únicamente a recibir medicamentos o consultas médicas, la Corte Constitucional ha dejado claro que el transporte, el alojamiento y hasta la alimentación pueden convertirse en piezas fundamentales para que los pacientes realmente accedan a los servicios de salud.
En la Sentencia T-316/24 la Sala Cuarta de Revisión de la Corte Constitucional analiza la configuración de la vulneración del derecho mencionado exponiendo que: “si bien los servicios de transporte, alojamiento y alimentación no constituyen, en estricto sentido, servicios de salud, pueden llegar a ser indispensables para garantizar la materialización del derecho fundamental a la salud, toda vez que contribuyen a eliminar barreras desproporcionadas que limitan el acceso de los pacientes a los servicios de salud”.
Por otro lado, la sentencia T-122/21 nos dice que: “la efectividad del derecho fundamental a la salud abarca las garantías de accesibilidad e integralidad de los servicios requeridos por los usuarios del Sistema de Salud”, servicios que ya mencionamos”. Sin embargo, La Corte Constitucional ha fijado subreglas específicas que permiten determinar en qué casos las EPS están obligadas a cubrir los gastos de transporte, alojamiento y alimentación de los pacientes y, en algunos casos, de sus acompañantes.
En primer lugar, el transporte dentro de la misma ciudad (intraurbano), en principio, debe ser asumido por el paciente o su familia. No obstante, puede ser reconocido por el sistema de salud cuando se demuestra que ni el paciente ni sus familiares cercanos cuentan con los recursos para cubrir el traslado y que negarlo pondría en riesgo la vida, la integridad o la dignidad de la persona.
Por otro lado, el transporte entre municipios (intermunicipal) sí está incluido directamente en el Plan de Beneficios en Salud (PBS). Esto significa que la EPS debe autorizarlo siempre que sea necesario que el paciente se desplace a otra localidad para recibir un tratamiento o procedimiento, y sus costos deben asumirse con cargo a la Unidad de Pago por Capitación (UPC).
También se reconoce la necesidad del transporte aéreo, en aquellos casos en los que, debido a las condiciones del paciente o a la distancia a recorrer, resulta desproporcionado o riesgoso hacerlo por vía terrestre. Esta modalidad se concede, por ejemplo, cuando el paciente tiene limitaciones graves para desplazarse o cuando el viaje prolongado pone en peligro su salud.
En cuanto a los gastos de alojamiento y alimentación para pacientes, estos pueden ser cubiertos de manera excepcional. Para que ello ocurra, se deben cumplir tres condiciones: que el paciente y su familia no tengan capacidad económica, que negarlo represente un riesgo para la vida o la salud, y que la atención médica requiera más de un día en el lugar donde se presta el servicio.
Finalmente, la Corte también ha previsto la posibilidad de otorgar transporte, alojamiento y alimentación a los acompañantes de los pacientes. Esto aplica cuando se demuestra que la persona enferma depende totalmente de un tercero para movilizarse, necesita atención permanente para garantizar su integridad y sus actividades cotidianas, y su núcleo familiar no cuenta con los recursos para cubrir esos gastos.
Si usted o un familiar se encuentra en una situación similar, en la que la EPS no garantiza los servicios de transporte necesarios para acceder a sus tratamientos, recuerde que este es un derecho protegido por la Constitución y la Corte Constitucional. En estos casos, puede acudir a la asesoría legal para reclamar lo que le corresponde.
