Con la entrada en vigencia de la más reciente reforma laboral, se fortalecen los derechos de las trabajadoras y trabajadores del servicio doméstico en Colombia. En cumplimiento del Convenio 189 de la Organización Internacional del Trabajo (OIT), ahora es obligatorio que toda vinculación laboral en este sector se formalice mediante contrato de trabajo escrito, el cual puede ser a término fijo, indefinido o por obra o labor, respetando siempre las garantías laborales.
Este contrato debe especificar las condiciones de la relación laboral, incluida la jornada laboral, que debe cumplir con los límites legales vigentes en Colombia. El empleador también está en la obligación de registrar al trabajador en la Planilla Integrada de Liquidación de Aportes (PILA), incluyendo novedades como el trabajo suplementario (horas extra).
En cuanto a prestaciones sociales, la reforma exige el reconocimiento pleno de derechos como prima de servicios, cesantías, intereses sobre cesantías, vacaciones, seguridad social en salud y pensión, y riesgos laborales, tal como establece la Ley 1788 de 2016. Incluso si el trabajador labora por tiempos parciales, el empleador debe realizar aportes proporcionales al Sistema de Seguridad Social.
Adicionalmente, los servidores domésticos que ya están afiliados al régimen subsidiado de salud podrán conservar esta condición como medida de protección social, mientras se realicen los aportes que exige la ley en contratos de tiempo parcial, de acuerdo con los artículos 27 y 28 de la Ley 2381 de 2024.
El Gobierno también anunció que el Ministerio de Tecnologías de la Información y las Comunicaciones deberá crear un sistema de información para registrar estos contratos, el cual deberá estar listo en un plazo máximo de 12 meses.
Con estas medidas, se busca que el trabajo doméstico sea digno, formal y protegido, avanzando hacia la equidad laboral para uno de los sectores más vulnerables del país.
